MelodyTailor – Terms of Service

1. Acceptance of These Terms

By accessing or using the website at https://melodytailor.com (the “Site”), our social media channels, or any related tools, features, or services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”).

If you do not agree, you may not use the Service.

We may update these Terms at any time. When we do, we will update the “Last updated” date and may provide additional notice. Continued use of the Service constitutes acceptance of the updated Terms.

2. Eligibility

You must be at least 18 years old to use the Service or place an order. If you act on behalf of a company or organization, you confirm you have authority to bind them to these Terms.

 

3. Description of the Service

MelodyTailor provides custom-made musical content, including:

  • Personalized songs

  • Custom lyrics

  • Audio messages

  • Digital audio files and previews

  • Communication tools to collect your story and preferences

We may modify or discontinue features at any time.

By using the Service, you consent to the processing of your personal data in accordance with GDPR and our Privacy Policy.

 

5. User Accounts

5.1 Registration

  • Notify us of unauthorized access

You are responsible for all activity under your account.

 

5.2 Termination

We may suspend or terminate accounts for violations of these Terms, fraudulent activity, or legal requirements. You may request account deletion at any time.

 

6. Orders, Pricing, and Payment

6.1 Orders

By placing an order, you confirm that:

  • All information you provide (story, names, details) is accurate

  • You have the right to share the content you submit

  • You understand that creative output is subjective.

6.2 Pricing

Prices are displayed on the Site and may change. The price at checkout is the final price for your order.

6.3 Payment

Payment is required in full at the time of order. We use third‑party payment processors; by paying, you accept their terms.

 

7. Delivery and Revisions

7.1 Delivery

Delivery times are estimates. Custom songs are delivered digitally (e.g., download link, email, or account access).

7.2 Revisions

If your package includes revisions, the number and scope will be specified at checkout. Revisions cover reasonable adjustments, not full rewrites.

 

8. Refunds and Cancellations

Because MelodyTailor creates custom-made digital content, refunds are generally not available once work has begun.

We may offer refunds at our discretion or where required by law.

 

9. Intellectual Property

9.1 Our Content

All content on the Service (design, text, audio, graphics, code) is owned by MelodyTailor or its licensors.

 

 

9.2 Custom Songs

Unless otherwise stated:

  • MelodyTailor retains copyright

  • You receive a personal, non-commercial license to use your custom song

  • You may share it privately or on personal social media (non‑monetized)

You may not:

  • Sell or license the song

  • Upload it to streaming platforms for revenue

  • Use it in advertising or commercial projects

Commercial rights require a separate agreement.

 

10. User Content

10.1 What You Provide

You may submit stories, names, descriptions, and other materials (“User Content”). You confirm that:

  • You own or have rights to the content

  • It does not infringe third‑party rights

  • It is lawful and appropriate.

 

10.2 License to Use

You grant MelodyTailor a license to use your User Content solely to create your custom song and operate the Service.

We will not publicly share your story without your consent.

 

11. Prohibited Conduct

You agree not to:

  • Use the Service unlawfully

  • Submit harmful, hateful, or infringing content

  • Attempt to hack or disrupt the Service

  • Use automated tools to scrape or copy content

We may take action if these rules are violated.

 

12. Third‑Party Services

The Service may link to third‑party websites (e.g., payment processors). We are not responsible for their content or policies. Your use of third‑party services is at your own risk.

 

 

13. Disclaimers

The Service and all content are provided “as is” and “as available”. We do not guarantee:

  • Uninterrupted or error‑free operation

  • That the final creative output will meet all subjective expectations

To the extent permitted by law, we disclaim all implied warranties.

 

14. Limitation of Liability

To the maximum extent permitted by Hungarian and EU law:

  • MelodyTailor is not liable for indirect or consequential damages

  • Our total liability for any claim is limited to the amount you paid for the specific service

Some consumer rights cannot be waived; those rights remain unaffected.

 

15. Indemnification

You agree to indemnify MelodyTailor against claims arising from:

  • Your use of the Service

  • Your User Content

  • Your violation of these Terms

  • Your violation of third‑party rights

 

16. Governing Law and Jurisdiction

These Terms are governed by the laws of Hungary.

Disputes shall be resolved by the competent Hungarian courts, unless EU consumer protection laws grant you the right to bring the dispute before the courts of your residence.

 

17. Consumer Rights and Withdrawal (EU/Hungary)

Under EU and Hungarian law, consumers normally have a 14‑day withdrawal right for online purchases.

However, this right does not apply to:

  • Custom-made products

  • Personalized digital content

  • Where performance begins with the consumer’s explicit consent

By placing an order, you:

  • Request immediate performance

  • Acknowledge that you lose your withdrawal right once creation begins

This is required by Directive 2011/83/EU and Hungarian Government Decree 45/2014. (II.26.).

19. Miscellaneous

  • Entire Agreement: These Terms + Privacy Policy + Additional Terms

  • Severability: Invalid provisions do not affect the rest

  • No Waiver: Failure to enforce a right is not a waiver

  • Assignment: You may not transfer your rights; we may assign ours in case of merger or sale.
